As many New Jersey couples have found out, the end of a marriage can be an emotional event. Moving on after a divorce is dependent on many issues, including the process itself. Although some individuals choose to handle divorce without assistance, others recognize the need for legal help. While each case differs, there are many reasons why having an attorney’s guidance helps.

It is important to present the facts of the situation to the court in a neutral and reasonable way. Emotions may be better kept out of the courtroom. An attorney who is experienced in divorce law and the process itself strives to provide what the court needs. Filing a document incorrectly may be detrimental, and it is important to follow the correct protocol.

Emotions may hinder an individual from working with the other side to procure the most advantageous settlement possible. Making sure that requests are reasonable and well-thought out is something a divorce attorney may do. Asking for something that is unreasonable may hurt a party in the end. Working out a settlement agreement by negotiating with a spouse may be preferable while letting a judge make the decision may not. A divorce attorney might help negotiate a settlement that is acceptable. Doing this also helps the divorce process get resolved more quickly.

There are many divorce legal issues with which a lay person will likely be unfamiliar, and divorce court procedures themselves that require the timely and complete filing of documents may be challenging without legal representation. Although some situations may appear at first glance to be simple, such as a couple who have been married for a short time and do not have any children, the advice and counsel of a family law attorney can still be invaluable for a divorcing spouse.
